13 years for McHenry stabbing

A 31-year-old McHenry man was sentenced to 13 years in prison Thursday after pleading guilty to stabbing his girlfriend’s brother in June 2010.

As part of the agreement, Luis Gaytan, of the 4500 block of Garden Quarter, can have his sentence for felony armed violence cut in half for good behavior.

He also will get credit for spending 11 months in jail.

Gaytan used a small, keychain pocketknife to stab the 34-year-old man at least three times in the ribs and back at the Garden Quarters apartment complex in the McHenry on June 23, officials said.

The victim, who has since recovered from his injuries, got into an argument with Gaytan and it turned physical.

McHenry police said at the time of Gaytan’s arrest that relatives tried to stop an intoxicated Gaytan from leaving a residence with his children.

McHenry County Assistant State’s Attorney Ryan Blackney, who prosecuted the case, also confirmed that Immigration and Customs Enforcement had placed a hold on Gaytan. That means Gaytan could be deported once his sentence is served.

“We’re happy with the sentence based on the facts of the case and the defendant was willing to accept his sentence short of taking the matter to trial,” Blackney said.

Judge Sharon L. Prather accepted the plea agreement in which charges of attempted murder and aggravated assault were dropped.
