Statement by teen in fatal shooting dismissed by judge

A Cook County judge has dismissed an incriminating statement from a teen charged in the fatal shooting of a 16-year-old on a Chicago Transit Authority bus last May.

Judge Michael Toomin said Tuesday Chicago police did not ensure that Kevin Jones, then 15, understood his constitutional rights to remain silent and to have an attorney present when questioned about the shooting of Blair Holt.

Toomin noted it was well into interview before a prosecutor advised Jones that anything he said could be used against him in court.

Jones and 16-year-old Michael Pace have pleaded not guilty to murder charges.

Pace is accused of firing the shots that killed Holt and injured four others. Authorities say Jones gave Pace the .40-caliber semiautomatic firearm used in the shooting, making him legally responsible for the murder as well.
