Elgin man free on bond in pending child pornorgraphy case now accused of sexual assault
A 29-year-old Elgin man free on bond from a child pornography arrest in early February has now been charged with a January 2020 criminal sexual assault and sharing images from it.
Luis A. Alejandres, of the 700 block of Oakley Avenue, was initially arrested Feb. 6 and charged with nine felony counts of child pornography possession from April 2019, according to Kane County court records. Alejandres posted $10,000 bond and was released while the case was pending, records show.
Kane County prosecutors filed 11 felony charges against Alejandres this week, accusing him of sexually assaulting a woman Jan. 8, and "multiple other times," according to charging documents.
The charges are: two counts of criminal sexual assault/victim unable to give consent; five counts of criminal sexual assault/victim unable to give consent; and four counts of nonconsensual dissemination of a sex image, records show.
The Daily Herald submitted a Freedom of Information Act request seeking information and mug shots from both of Alejandres' cases. The city of Elgin and police department on Wednesday issued a full denial of any information, including Alejandre's mug shot, saying, in part, the investigation was "ongoing."
"All of the witnesses/suspects have not yet been interviewed and additional evidence may be available, so that release of the information may reasonably be expected to result in concealment of evidence and/or affect witness testimony," read a letter from the city.
Defense attorney Alex Bederka said Alejandres was arrested Tuesday on the criminal sexual assault charges and posted 10% of his $100,000 bail. Bederka declined to comment on the new charges, saying he did not have any information.
If convicted of the aggravated criminal sexual assault, Alejandres faces a sentence ranging from four to 15 years in prison and lifetime registration as a sex offender.
If convicted in the child pornography case, he also faces up to 15 years in prison. Alejandres is next due in court May 7.
